These Terms & Conditions ("Terms") govern your use of VITA, an AI fitness assistant developed and operated by Pollaris ("we", "us"). By creating an account or using VITA you agree to these Terms.
1. Acceptance of Terms
By downloading, installing, accessing, or using VITA, you confirm that you are at least 16 years of age and have the legal capacity to enter into a binding agreement. If you are using VITA on behalf of a minor for whom you are legally responsible, you accept these Terms on their behalf.
2. The Service
VITA is a software application that uses artificial intelligence to suggest workout routines, exercise variations, and general fitness guidance. VITA is a tool, not a medical service. We do not provide medical advice, diagnosis, treatment, or supervision.
3. Health Disclaimer
Physical exercise carries inherent risks. Before beginning any program suggested by VITA you should consult a qualified physician or licensed health professional, especially if you have any pre-existing medical condition, injury, or are pregnant. You assume full responsibility for any consequences resulting from following content generated or suggested by VITA. If at any time during exercise you feel pain, dizziness, or discomfort, stop immediately and seek professional help.
4. AI-Generated Content
VITA uses large language models and other AI systems to generate suggestions. AI output may be incomplete, inaccurate, or unsuitable for your specific situation. You agree not to rely on VITA as a substitute for professional medical, nutritional, or training advice.
5. Your Account
You are responsible for keeping your credentials secure and for any activity under your account. You agree to provide accurate information and to notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms or applicable law.
6. Subscription & Billing
VITA may offer paid plans through your platform's app store or directly. Subscriptions auto-renew until cancelled per the rules of the store where you purchased them. Refunds, where applicable, follow the policy of that store. Prices may change with reasonable notice.
7. Your Content
You retain ownership of the data you submit (workout logs, photos, messages). You grant Pollaris a limited license to process this data only to operate and improve VITA, as detailed in our Privacy Policy. You will not submit content that is unlawful, infringes on others' rights, or contains malicious code.
8. Intellectual Property
VITA, its design, software, name, logo, and all related materials are owned by Pollaris and protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable license to use VITA for its intended purpose.
9. Prohibited Use
You agree not to: reverse-engineer, decompile, or attempt to extract the source code of VITA; use VITA to harm others or violate any law; use VITA to develop a competing product; or interfere with the security or integrity of the service.
10. Disclaimer of Warranties
VITA is provided "as is" and "as available". To the maximum extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.
11. Limitation of Liability
To the maximum extent permitted by law, Pollaris and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of VITA. Our aggregate liability will not exceed the amount you paid us in the twelve months preceding the claim.
12. Termination
You may stop using VITA at any time. We may suspend or terminate your access if you violate these Terms or if we reasonably believe it is necessary to protect users or the service. Sections that by their nature should survive termination will do so.
13. Governing Law
These Terms are governed by the laws of the Federative Republic of Brazil, without regard to conflict-of-law principles. Disputes will be resolved by the courts of São Paulo, Brazil, except where mandatory consumer-protection law provides otherwise.
14. Changes to These Terms
We may update these Terms from time to time. If a change is material we will notify you in-app or by email at least 14 days in advance. Continued use after the effective date means you accept the updated Terms.
